Ce contrat constitue un accord juridiquement contraignant entre les parties ci-dessous.

2. OBJET DU CONTRAT

Le présent contrat a pour objet la mise à disposition d’un bateau de plaisance exclusivement pour une navigation sur le lac d’Annecy.

Immatriculation : BL798790 Capacité : 8 personnes maximum
Carburant : Essence + huile 2T Réservoir : 97 litres

3. DURÉE & RESTITUTION

La durée de location est définie lors de la réservation en ligne et confirmée par email. Toute modification doit être validée par écrit par le Loueur.

Le bateau doit être restitué à l’heure et à l’emplacement convenus.

Pénalités de retard :

  • 190 € / heure entamée
  • Minimum facturé : 45 €
  • Retenue possible sur caution

4. PRIX & PAIEMENT

  • Tarifs consultables sur www.annecy-boat.com
  • Carburant non inclus (sans skipper)
  • Facturation carburant : 2,60 € / litre TTC

Caution : 1 000 € exigés avant départ

La caution peut être retenue en cas de :

  • Dommages matériels
  • Perte ou casse d’équipement
  • Nettoyage exceptionnel
  • Remorquage
  • Retard
  • Consommation carburant/huile
  • Pertes d’exploitation

5. CONDITIONS D’UTILISATION

Le Locataire certifie :

  • Être titulaire d’un permis valide
  • Être apte à la navigation
  • Ne pas être sous alcool ou stupéfiants
  • Ne pas consommer pendant la location

Interdictions strictes :

  • Navigation hors lac d’Annecy interdite
  • Zone de navigation obligatoire
  • Vitesse max : 50 km/h
  • 5 km/h en zones réglementées
  • Max 8 personnes à bord
  • Usage illégal interdit

Toute violation entraîne la résiliation immédiate sans remboursement.

6. RESPONSABILITÉ

  • Le Locataire est responsable du bateau pendant toute la durée
  • Il assume tous dommages causés
  • Navigation sous sa seule responsabilité

7. ANNULATION

  • +48h : remboursement intégral
  • 24–48h : 50%
  • -24h : aucun remboursement

Conditions météo : décision du Loueur (remboursement total ou partiel selon durée impactée).

8. ASSURANCE

Le bateau est assuré conformément au droit français.

  • Responsabilité du Locataire pour tous passagers
  • Exclusion des effets personnels
  • Exclusion dommages indirects

9. DROIT APPLICABLE

Droit français. Tentative de résolution amiable obligatoire avant action judiciaire.

PLEASURE BOAT RENTAL AGREEMENT (Anglais)

This agreement is a legally binding contract between the parties below.

1. PARTIES

LESSOR
Green Timothy / Annecy Boat

Hereinafter referred to as “the Lessor” 		LESSEE
Hereinafter referred to as “the Lessee”

2. BOAT DETAILS

Boat: Liberté 150 HP Model: Seastar 1980
Registration: BL798790 Capacity: 8 persons max
Fuel: Petrol + 2-stroke oil Tank: 97 litres

3. RENTAL PERIOD

The rental period is defined during online booking and confirmed by email. Any modification must be approved in writing by the Lessor.

The boat must be returned at the agreed time and location.

Late return penalties:

  • €190 per started hour
  • Minimum charge: €45
  • May be deducted from the security deposit

4. PRICING & SECURITY DEPOSIT

  • Pricing available on www.annecy-boat.com
  • Fuel not included (without skipper)
  • Fuel charged at €2.60 / litre (VAT included)

Security Deposit: €1,000

The deposit may be retained in case of:

  • Material damage
  • Loss or breakage of equipment
  • Excess cleaning
  • Towing costs
  • Late return
  • Fuel / oil consumption
  • Loss of rental income

5. CONDITIONS OF USE

The Lessee confirms that they:

  • Hold a valid boating license where required
  • Are capable of safely operating the vessel
  • Are not under the influence of alcohol or drugs
  • Will not consume alcohol or drugs during the rental

Strict prohibitions:

  • No navigation outside Lake Annecy
  • Must stay within authorised zones
  • Max speed: 50 km/h
  • 5 km/h in regulated areas
  • Maximum 8 persons onboard
  • Illegal use strictly prohibited

6. LIABILITY

The Lessee is fully responsible for the boat during the rental period and assumes all damages caused.

7. CANCELLATION POLICY

  • +48 hours: full refund
  • 24–48 hours: 50% refund
  • -24 hours: no refund

In case of dangerous weather conditions (wind, storms, heavy rain), the Lessor may cancel the booking with a full or partial refund depending on the unused period.

8. INSURANCE

The boat is insured in accordance with French regulations.

  • Full responsibility of the Lessee for all passengers
  • Exclusion of personal belongings
  • Exclusion of indirect damages
  • Insurance excess remains the responsibility of the Lessee

9. GOVERNING LAW

This agreement is governed by French law. Any dispute must first be subject to amicable resolution before legal proceedings.
